Agreement to Terms

Welcome to Kaavala. These Terms of Service ("Terms") govern your use of the Kaavala mobile application ("App") operated by Forward Alpha ("we," "us," or "our").

By downloading, installing, or using Kaavala, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Kaavala is a personal safety application that provides:

SOS emergency alert system
Live location sharing with trusted contacts
Volunteer escort request services
Harassment incident reporting
Evidence recording capabilities

Important Notice: Kaavala is designed to supplement, not replace, emergency services. In case of immediate danger, always contact local emergency services (police, ambulance) directly. Kaavala does not guarantee response times or availability of volunteers.

Eligibility

To use Kaavala, you must:

Be at least 13 years of age
Have the legal capacity to enter into these Terms
Provide accurate and complete registration information
Have a valid phone number for verification

If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your account credentials secure
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

Acceptable Use

You agree to use Kaavala only for lawful purposes. You must NOT:

Trigger false SOS alerts or make fake emergency reports
Use the App to harass, threaten, or harm others
Impersonate another person or entity
Provide false information about incidents or emergencies
Interfere with or disrupt the App's functionality
Attempt to gain unauthorized access to the App or its systems
Use the App for any illegal or fraudulent activity
Misuse the volunteer escort service
Share inappropriate or illegal content through the App

                False Alerts: Deliberately triggering false SOS alerts wastes critical resources and may result in immediate account termination. In some jurisdictions, false emergency reports may also be a criminal offense.
            

Volunteer Services

Kaavala connects users with volunteer escorts who have undergone KYC verification. However:

Volunteers are independent individuals, not our employees
We do not guarantee volunteer availability at all times
We conduct verification but cannot guarantee volunteer behavior
Users should exercise their own judgment when accepting escort assistance
Both users and volunteers must treat each other with respect

Volunteer Responsibilities

If you register as a volunteer, you additionally agree to:

Complete identity verification (KYC) truthfully
Respond to alerts only when able to provide genuine assistance
Behave professionally and respectfully at all times
Not request or accept payment from users
Report any concerning behavior through proper channels

Location Services

Kaavala requires access to your device's location services to function properly. By using location-based features, you consent to:

Collection of your location data when features are active
Sharing your location with emergency contacts during SOS events
Sharing your location with volunteers during escort services

You can disable location services at any time through your device settings, but this will limit the App's functionality.

Content and Evidence

The App allows you to record audio, video, and photos during emergencies. You are solely responsible for any content you create and share through the App. You agree that:

You will only record content where legally permitted
You will not record or share content that violates others' privacy rights
Evidence recorded through the App may be used by you for legal purposes
We may access evidence data if required by law or to investigate violations

Intellectual Property

The App, including its design, features, content, and trademarks, is owned by Forward Alpha and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

Copy, modify, or distribute the App
Reverse engineer or decompile the App
Remove any proprietary notices from the App
Use our trademarks without written permission

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The App will be uninterrupted, secure, or error-free
SOS alerts will always be delivered successfully
Volunteers will always be available or respond
Location data will always be accurate
The App will meet your specific requirements

Safety Disclaimer: While Kaavala is designed to enhance personal safety, we cannot guarantee your safety or security. The App is a tool to assist you, but you should always prioritize contacting local emergency services in dangerous situations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORWARD ALPHA SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities
Personal injury or property damage resulting from your use of the App
Actions or inactions of volunteers or other users
Failure of emergency alerts to be delivered or received
Technical failures, network issues, or service interruptions

Our total liability for any claims shall not exceed the amount you paid to use the App in the past 12 months.

Indemnification

You agree to indemnify, defend, and hold harmless Forward Alpha, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Content you create or share through the App

Termination

We may suspend or terminate your access to the App at any time, without notice, for any reason, including:

Violation of these Terms
False SOS alerts or fraudulent activity
Harassment of other users or volunteers
Any behavior that endangers others or the community

You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of [Your City], India.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward Alpha regarding your use of the App.
